If the case needs to be tried and we’ve worked hard and had the case early, we’re going to go to the scenes, we’re going to get witness recollections, we’re going to get statements, we’re going to get photographs, we’re going to do all of the things that needs to be done. You can’t have a great house if your foundation is built on sand, you didn’t pour in solid brick, and you just decided to put stones up; no matter how great your house looks it’s going to fall apart.

Your lawsuit is basically the same, it may look great and you may have five witnesses who have great credentials but if you didn’t do all of the work to underscore and to make sure that that evidence is there, preserved & protected, then those witnesses will look bad. If you didn’t do the work to find out that your client had had a prior back injury that they may have forgotten about or that there was something that they’re doctor did not know because it wasn’t communicated to him, when you put that doctor on the stand he’s going to look very weak and you won’t get the proper respect from the jury and the jury may not even give you an award at all. All of that stuff before you put those people in play, such as doctors or witnesses, they need to have a solid foundation. They need to know that the work has been done.
